From the radio news report I heard today, it appeared that the jury proceeded diligently, not just selecting "Answer A" to all the questions. For example, the jury found that some Samsung phones infringed, and some didn't. I wonder if there was an engineer or 2 on the jury, to help keep the process moving in a logical fashion.
I must say, totally apart from the so-called merits, I fear that this will embolden Apple in what some people consider to be unjustified claims (and patents). But, the appeal is next; and in patent cases, there is a high reversal and remand back to the trial court rate (the last time I saw the reversal rate, it was between a third and 50%--that's very high in lawsuits) . . . . |

Personally, from all the Samsung devices I've used & seen, Apple had a case.

But I wonder, should it have had a case? I really wasn't following the case that closely, but from what I was hearing, monopoly protection for a trash icon showing a trash can? For a rectangular-shaped tablet telephone surface with rounded corners?

A lot of Apple "innovations" are rip offs of Sony and Palm so those companies should be awarded billions of dollars. That's American protectionism for ya. I generally avoid most U.S companies as they stick to spending money on advertisement and suing others instead of innovating and actually making good products. With all due respect, it's not the Court system (American or otherwise) and it's not the fact that it's Apple. It's the patent system and what it says about who owns what. The result would have been the same if Samsung had gotten there first, only for Samsung.
And while Apple spends oodles on advertising, it also does a fair amount of innovating, it seems to me, in one fashion or another. |

Interesting development: the U.S. Patent and Trademark Office recently has invalidated one of the major patents in the Northern California Apple vs. Samsung lawsuit--the "rubber-banding" patent. Of course, Apple will have the opportunity to appeal this within the Patent Office and then, if unsuccessful, to the U.S. Federal Court of Appeals.
And, as one might expect, Samsung already has brought this development to the attention of the Apple vs. Samsung trial judge, asking that the jury's verdict be set aside (or modified?), as a result. It ain't over 'til it's over . . . . |
