It seems you're reporting that a amazon vendor tdbk93 sold you a faulty product. If that's the case you need to use amazon's return policy to return the item and get your money back. AFAIK there's no way to sue so returning it is all you can do.

If you can't return it be sure to give them clearly written negative feedback on amazon and post a link to it here. That might save someone else from giving their money to a shoddy vendor.
