I guess I'm looking for some SIGNAL of MS's intents re: this issue. Will they actively seek to close the back door / firmware close the hack aka the Sony/PSP firmware approach ? Will they disregard it until some hack somehow puts at risk the Marketplace security / DRM of the content via Zunepass (if that is even possible?) ???

I'd assume they'll treat it like XDA Developers. In their case, Microsoft already got their license money from the phone's manufacturer to have Windows Mobile on it. Who cares if some people want to make custom ROMs for their phone with modified, new, or leaked versions of their OS if Microsoft already made money from it. It's not like Microsoft would be able to get more money from the same phone anyway. As long as there's no piracy or theft taking place, people are free to do what they want with their devices. The only difference between Window Mobile and the Zune HD is that Microsoft made the hardware. However, they still got their money for the hardware and continue to receive it from Zune Pass subscribers. Like someone said earlier, if DRM is broken or circumvented, that's when they'll probably step in because that would result in the loss of money and destroy the Zune's ecosystem/business model.
